Terms of Service

These Terms of Service ("Terms") govern your use of the Pactup mobile application and website (the "Service") operated by Almas Mirzakhmetov, an individual developer based in Kazakhstan ("we", "us", "our"). By using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use Pactup. By creating an account, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms.
2. Account
- You sign in using Google or Apple. You are responsible for maintaining the security of your sign-in credentials.
- You may choose any display name that does not impersonate another person or violate these Terms.
- You may have only one active account. We may suspend duplicate accounts.
3. Acceptable Use
You agree not to:
- Tamper with, reverse-engineer, or circumvent the usage-tracking or snapshot-signing mechanisms.
- Upload false, misleading, or fabricated usage data.
- Harass, bully, or threaten other participants via chat or any other feature.
- Use the Service for any illegal purpose.
- Attempt to access another user's account or data.
- Use automated tools, bots, or scripts to interact with the Service.
4. Challenges and Stakes
- Challenges are voluntary commitments between participants. Pactup facilitates tracking and accountability but is not a party to any challenge.
- Stakes are optional, lighthearted suggestions intended purely for fun between friends (e.g., "loser buys coffee", "post a silly selfie"). Stakes have no monetary or legal value and are not enforceable obligations. Whether or not participants fulfill a stake is entirely voluntary.
- Pactup is not a gambling, betting, or wagering service. No real money, cryptocurrency, or items of value are exchanged through the app. Stakes are creative text descriptions only — the app does not facilitate, process, or track any transfer of value between users.
- Pactup does not enforce, mediate, or guarantee the fulfillment of stakes. Any consequences of stakes are informal and between you and other participants. Pactup is not liable for any loss or harm arising from stakes.
- You may leave a challenge at any time. Leaving is recorded as a "give-up" and visible to other participants.
5. Screen Time Data
- Pactup collects usage data only for apps you explicitly select within an active challenge.
- Usage snapshots are cryptographically signed on your device before upload. You acknowledge that this data is shared with other participants in the same challenge.
- You may export or delete your data at any time from the app's settings.
6. Subscriptions
- Pactup offers free and paid tiers. Paid subscriptions are billed through Apple App Store or Google Play.
- Subscription management (cancellation, refunds) is handled by the respective app store. Refer to their policies for details.
- We may change pricing with 30 days' notice. Existing subscriptions are honored at their current price until renewal.
7. License to Use the Service
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms. This license does not include the right to modify, distribute, or create derivative works from the Service.
8. Intellectual Property
The Pactup name, logo, design, and code are owned by us. You may not copy, modify, or distribute any part of the Service without our written permission. Content you create (chat messages, display names) remains yours, but you grant us a worldwide, royalty-free license to display, host, and distribute it to other challenge participants as part of operating the Service.
9. Termination
- You may delete your account at any time from the app's settings. Deletion permanently removes your profile, challenges, and associated data within 30 days.
- We may suspend or terminate your account if you violate these Terms or engage in abusive behavior.
10. Content Reporting
If you encounter content in chat that is abusive, harmful, or infringes on your rights, please report it to [email protected] with the challenge name and details. We will review and take appropriate action, including removing content and suspending accounts where necessary.
11. Disclaimers
- The Service is provided "as is" without warranties of any kind, express or implied.
- Pactup is not a health or wellness service. We do not provide medical, psychological, or therapeutic advice.
- We do not guarantee that the Service will be uninterrupted, error-free, or secure at all times.
- Usage data accuracy depends on your device's operating system APIs and may vary between devices.
12. Limitation of Liability
To the maximum extent permitted by law, Pactup shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.
13. Dispute Resolution
If you have a dispute with us, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days. If the dispute cannot be resolved informally, it shall be submitted to the courts of the Republic of Kazakhstan.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top and notify you through the App. Continued use after changes constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to conflict of law provisions.
